APPLICATION FOR INTERIM RELIEF
(CEASE & DESIST) FOR “OFF DUTY STATUS”

Dear Brothers and Sisters,

The Committee of General Chairpersons held a hearing in front of Arbitrator Corrin Bell on February
11, 2021, to make application for Interim Relief (Cease & Desist) for the company’s recent misuse of
placing members on “Off Duty Status” per Article 20.14 of the TMOS Collective Agreement.

The Union has made its position clear since June that the emergency situation has come and gone
and that we are now living in the new reality of the global pandemic. The Union has further made its
position clear that using this clause while other members are in receipt of benefits of Article 16 (the
right to bump and displace) and keeping some members in the workplace and sending other members
home without salary out of seniority has caused a poisoning of the work environment which we believe
will be almost impossible to repair, if Air Canada’s management continues this course of action.

Arbitrator Bell is now in receipt of both parties’ arguments and should render a decision before
February 17, 2021. As this was an application for Interim Relief and not a hearing to litigate the merits
of the grievance itself, should the Union be unsuccessful in obtaining a Cease & Desist order, the
grievance itself will be heard at a later date to be determined.
