TO ALL IAMAW MEMBERS AIR CANADA TMOS OFF-DUTY STATUS GRIEVANCE UPDATE

Dear Brothers and Sisters,

Further to Bulletin No. 32 dated June 5, 2021, significant and positive progress has been made in regard to the Off-Duty Status (ODS) grievance argued successfully at arbitration on May 12, 2021.

In her award dated May 27, 2021, Arbitrator Christine Schmidt upheld the Union’s grievance and directed Air Canada to cease and desist the application of Article 20.14 of the current Collective Agreement. Arbitrator Schmidt further referred the issue of remedy back to the parties, while remaining seized.

While engaged in discussion regarding remedy subsequent to the decision, Air Canada Labour Relations advised DL140 of their intention to make an application for judicial review (JR) of Ms. Schmidt’s award. The schedule for such application was set and has now concluded.

Your Union is pleased to advise that on September 13, 2022, the court dismissed Air Canada’s application on the spot, and awarded costs to the IAMAW.

Your Committee of General Chairpersons contacted the employer immediately upon receiving notice of the Court’s decision. Productive discussion regarding remedy can now continue, without the distraction of pending judicial review.
