AIR CANADA – APPLICATION FOR
INTERIM RELIEF – OFF DUTY STATUS
Dear Brothers and Sisters,
As a follow up to Bulletin No. 006 dated February 12, 2021, Arbitrator Corinn Bell has rendered
her decision on the Union’s application for interim relief against Air Canada’s misuse of Article
20.14 – Off Duty Status.
Unfortunately, the Union’s application was unsuccessful. In her award dated February 18th,
Arbitrator Bell goes into significant detail outlining the difficult three part legal test that must be
met in order to grant interim relief and her rationale for the final decision.
By now many of you have viewed her written award via social media. It is very important to
understand that the grievance against “ODS” is still very much active. The argument is far from
District Lodge 140 is working diligently to secure a date as soon as possible to advance the
grievance to arbitration. At this time the next National arbitration date is scheduled for May 12th
with Arbitrator Christine Schmidt, but your General Chairpersons are exploring all options to
have the grievance heard sooner.
In the meantime, your Union has requested that Air Canada provide a timeline for when “ODS”
will transition to the provisions of Article 16. The company has been unwilling to commit to
