UPDATE – ARTICLE 13.02 VACATION

Dear Brothers and Sisters, On October 29, 2019 District 140 presented a grievance before
Arbitrator Schmidt in the National hearing forum. The grievance was based on Article 13.02
of the Collective Agreement.
The Employer is not allowing Members working a compressed work with paid statutory holidays
to take applicable holiday’s in conjunction with bid vacation. In addition, concerns were present
regarding the length of response time for approvals and denials in reference to some requests.
The award was ultimately influenced by operational requirements and the limitation of vacation
slots available for bid. Both of which remain subject to the Employers discretion.
The award provides for structure, process and some accountability on behalf of the Employer
regarding these Member requests. Please refer to the attached award for clarity.
