Dear Brothers and Sisters:
On April 14, 2011 the Union put forward the following question to Arbitrator Martin Teplitsky and requested a decision regarding this matter:
For Members who have expressed a desire to outright retire from Air Canada, independent of the Transition Process, with a retirement date of August 1, 2011 or earlier. Can they simply be treated as normal retirements and processed separately from the Transition Process?
The intent of this question was to exclude Members, who have expressed their desire to retire from Air Canada on or before August 1, 2011, from the Transition Process and then consider the vacated positions, due to a retirement, as vacant positions available for filling on the Transition date.
On this same day Arbitrator Teplitsky issued the following Decision regarding this matter:
So long as the Union advises the employers before the selection work commences of the individuals who have made this choice the proposal is sensible.
Based on the aforementioned, any TMOS Maintenance or Clerical Member wishing to be excluded from the Transition Process and retire from Air Canada, on or before August 1, 2011, must notify their respective TMOS Maintenance Shop Committee or Clerical Chief Stewards immediately.
