Dear Brothers & Sisters:
On October 17, 2012, at Air Canada’s request, a Category 33/CSCA merger arbitration hearing took place in Toronto. At this hearing, Arbitrator Martin Teplitsky advised the parties that he did not have the jurisdiction to merge these Categories & Classifications. However, the Arbitrator advised the parties that he did have the jurisdiction to amend his 2008 protocol decision regarding the intermingling of these Categories & Classifications.
Based on the aforementioned, the Union expects Arbitrator Teplitsky to amend his 2008 Category 33/CSCA protocol decision and that an award will be forthcoming. Once the Union receives an Arbitration Decision regarding this matter it will be released to the Membership.
