TO ALL AIR CANADA IAMAW MEMBERS
PENSION MOA

Dear Brothers and Sisters:

On December 21, 2020, Air Canada filed an application to the Minister of Labour requesting a
waiver from the Group Termination Notice requirements of the Canada Labour Code (CLC).

After receiving a copy of the Group Termination Notice wavier application filed with the
Minister of Labour, our legal counsel filed an objection.

On February 12, 2021, the Minister of Labour denied Air Canada’s Group Termination waiver
request.

As a result of the denied waiver, the provisions of the Joint Planning Committee per Division
IX of the CLC were enforced.

Per Division IX of the CLC, the Joint Planning Committee is responsible for the development
of an adjustment program as part of the Division IX process. As a result of discussions held
between the parties pursuant to the Division IX process, the IAMAW entered into a Lay-off
Mitigation Memorandum of Agreement which provides members who are at least age 55 with
80 points of age plus service in the pension plan with an option to take an additional
temporary pension until the age of 65. It also provides members who have not reached the
age of 55 or do not have 80 points, the option to take an unreduced pension at their 55/80
date rather than at age 65.
