ODS AND PENSION BUYBACK
Dear Brothers and Sisters,
Those of you affected by periods of ODS in 2021 should be aware that you have the
opportunity to buy back that unaccumulated pensionable service.
To apply for the buyback, you are required to contact HR Connex within 90 days after
returning to work from ODS. This was previously communicated in a Company
document dated January 2021.
In light of the recent arbitration decision upholding the Union’s grievance regarding the
misuse of ODS for a second time since the outset of the pandemic, many Members are
seeking guidance regarding pension buyback.
Arbitrator Schmidt referred the issue of remedy back to the parties. DL140 and Air
Canada Labour relations are currently discussing remedy and that dialogue is ongoing,
but not concluded. If no resolution can be achieved, Arbitrator Schmidt remains
seized and the issue will be brought back to her for a final ruling.
While remedy discussions continue, the Company has agreed to extend the 90-day
window for pension buyback indefinitely. At this time there is no action required. If
there is any change to this agreement, we will communicate immediately.
