WHO OPTED TO RETIRE/RESIGN
FROM AIR CANADA AND REHIRE BY AVEOS

RE: DISTRIBUTION OF EXCESS FUNDS UNDER
CIRB ORDER 9996-U AND
THE SEPTEMBER 12, 2012 ARBITRATION DECISION

Dear Brothers and Sisters,

Further to Bulletin No.35 issued June 18th, 2015, please be advised that the reconsideration application filed before the CIRB by certain members seeking to prevent this distribution was dismissed on July 8, 2015. In addition, a Judicial Review application concerning the same issue was dismissed by the Federal Court of Appeal, with costs payable to the Union on November 24, 2015.

As such, the Union intends to proceed with a distribution of these funds to Members who were employed at Air Canada on January 31, 2011, who opted to retire or resign from Air Canada as part of the Aveos transition process, and who were still working at Aveos at the time of its closure, since they have not received any compensation for their losses resulting from transitioning to Aveos in the context of its insolvency and closure.
