RE: ELIMINATION OF CONNECTION BAGGAGE / LAV AND WATER LEADS IN YYZ, YUL, YYC AND YVR
Dear Brothers and Sisters:
Transportation District 140 met with the Company in Toronto on June 4, 2013 in front of Chief Arbitrator Martin Teplitsky. The Union presented a grievance against Air Canada’s position regarding the elimination of Connection Baggage Leads in Toronto, Montreal, Calgary and Vancouver. The Company is claiming that these positions are no longer required due to technological changes that they are implementing.
Air Canada also advised the Union and the Arbitrator that they were also eliminating the Lav and Water Lead positions from Toronto for the same reasons.
The Union argued that this was not a case of technological change, but in fact a movement of Scope Work into management positions. The Union also stated that the Company did not comply with any of the clauses or timeframes in the Collective Agreement under Article 20.20 (Tech change).
Attached is the Chief Arbitrator Teplitsky’s Award on this issue; to paraphrase, the Company did not comply with Article 20.20.03. Therefore the Company must meet with the Union and produce a detailed proposal of their intentions and plans for these positions proving that this is indeed technological change.
This meeting is scheduled in Vancouver on July 3, 2013. Further to the above if the Union contends that the Company is transferring work to management we will bring that before the Chief Arbitrator Teplitsky for resolve.
