INTERIM ARBITRATION AWARD – SHIFT SCHEDULING

Dear Brothers and Sisters,

On January 20, 2015 a hearing was held in Toronto with Arbitrator Brian Keller in respect to Shift Scheduling.

The following is the Interim Award handed down by Arbitrator Keller. In it he states he is remitting this issue back to the Company and the Union to try to work this out together and if the matter is not resolved within 90 days, or such other time as may be agreed, he will decide the outcome.

INTERIM AWARD

This award deals, on a preliminary basis, with the aforementioned grievance. For the purposes of this interim award, suffice it to say that the parties are unable to agree, on a go forward basis, on the shift schedule(s) for affected employees, notwithstanding the discussions that have taken place between them.

The issue of shift scheduling has bedeviled parties in all industries from time immemorial. It clearly affects the lives of employees, as well as the ability of the employer to operate efficiently and effectively. The provisions of the collective agreement reflect, in my view, that the parties have turned their minds to attempting to achieve a balance between the needs of employees and the employer.

On a preliminary basis, I believe it is safe to say that that the balance does not include a 4 x 4, with stats. That rotation does not fit within the parameters of reasonability. I am also of the view, on a preliminary basis, that MOU 4 provides the parameters that should instruct the parties.

Accordingly, I remit this issue back to the parties as they, ultimately, are in the best position to determine what is in their mutual best interest. However, this matter requires finality. Accordingly, if the matter is not resolved within 90 days, or such other time as may be agreed, I will decide the issue. Each party will present its desired shift and appropriate rationale, and I will award the one that I consider to be most appropriate.

I remain seized as required.
