DL140 Bulletin -Update on Transition CIRB Hearings

UPDATE ON TRANSITION CIRB HEARINGS

On September 29th, 2010 a hearing was held at the Canadian Industrial Relations Board (CIRB). The contentious issue of this session was the refusal of the employer to provide relevant information regarding AVEOS’ financial viability and future business plan.

During the deliberations (argumentative and theatrical) it became apparent that both Air Canada and AVEOS are of the opinion that the language contained within the previously negotiated Transition Document (MOA) gives them the undisputed right to separate the bargaining unit certification by the dates outlined within the transition documents and negotiated articles.

It is their position that, should these dates not be achieved, items within the MOA itself may be altered or voided. The maintenance agreement (Service Level Agreement) between the two employers is set to expire in December 2013. The employer representatives also view the past financial reorganization of both companies as encouraging. They say creditors are content with the restructuring agreements so Aveos must be viable because they are still here. As unsecured creditors we continue to see our concessionary agreements mismanaged and remain the largest group of individuals with a vested interest in the continued operation of the employer. Apparently justice for all is overshadowed by the greed of a few.

At this time we are awaiting the CIRB decision pertaining to our request for further financial information. We will inform you of any further developments or possible meetings.
