TO ALL MEMBERS OF THE IAMAW

UPDATE: AIR CANADA/AVEOS CERTIFICATION ISSUE AT THE CIRB

Dear Brothers and Sisters:

I, along with IAMAW Transportation Coordinator Carlos DaCosta and our lawyers, Jim Hayes and Amanda Pask, attended the Case Management Hearings on September 20th and 21st at the Toronto offices of the Canadian Industrial Relations Board (CIRB).

The CIRB panel hearing this case is made up of Elizabeth MacPherson, CIRB Chairperson, Pat Heinke, employer representative and former Air Canada management member, and Daniel Charbonneau, union panel member and former IAM shop committee member from Local Lodge 1751.

The panel heard opening statements and then the parties adjourned to separate rooms to identify, with the assistance of the panel’s employer and union representatives, the issues that each party is asking the panel to consider.

Our position has been made very clear to the panel and the two companies. We do not have enough information at this time for us to make a determination whether Aveos’ restructuring plan is viable and whether it remains a common employer with Air Canada. We have requested further financial disclosure information.

At the end of the day on the 21st, the Chairperson informed us that the schedule for the actual hearing dates is as follows:

September 29th, 2010 at 10:00 a.m.

October 4th, 5th, & 6th at 10:00 a.m.
Ottawa CIRB Offices
4th Floor West
240 Sparks Street
Ottawa, Ontario

We informed the panel that, due to the nature of the decision they will be making, we expect that our members will want to and should be allowed to attend all of the hearings in the future.

Any members wishing to attend the hearings will be responsible to make their own arrangements to do so.
