RE: OVERTIME
Some of you have raised concems recently about the way overtime is distributed and the maximum overtime hours allowed under Federal Labour Law.
As per the Collective agreement, Article 18.09, overtime shall be distributed equitably among qualified employees. This means that overtime shall be awarded on a rotational basis to the senior employee with the least amount of overtime hours in a quarter (every 3 month period starting with January 1st), not strictly by seniority.
Under Federal Labour Law, the maximum hours worked in a week is 48 hours total (104 hours in a quarter year).
See the quoted text from the HRSDC website:
Hours of Work The standard hours of work are eight hours in a day and 40 hours In a week. The maximum number of hours of work for a week is 48 hours. Certain provisions permit flexibility in applying these standards. As well, special regulations cover certain classes of workers in specific industries such as city and highway transport drivers . However, the Code makes no distinction between full-time, part-time or casual workers.
