ONE CATEGORY GRIEVANCES
Dear Brothers and Sisters,
As a follow-up to bulletin No. 005 issued on January 27th of this year, the arbitration process has now concluded for the grievances regarding one-category recall.
This arbitration hearing was raised to a full evidentiary process and the parties required three (3) full days to make all arguments.
Unfortunately, Arbitrator Schmidt ruled in favour of the Company and dismissed the Union’s grievances.
Ms. Schmidt wrote a very detailed nineteen (19) page award summarizing the parties’ positions and her rationale for her final decision.
It must be made clear that a distinction was made between one-category “bumping” and “recall.” Members were not denied the right to “bump” into entry level classifications, if their seniority at the time of the bump allowed them to do so.
Members were subsequently denied “recall” rights into the CSCA positions in which they had never held seniority.
Your Air Canada General Chairpersons are highly disappointed with this result.
